Information Collection and Use

Personally-Identifiable Information

When you register with us through the Services and become a Vendor or a Customer, when you choose to post a Listing or reserve a trip, or when you wish to contact another Vendor, we will ask you for personally-identifiable information. This refers to information about you that can be used to contact or identify you ("Identity Information"). Identity Information includes, but is not limited to your:

  • name,
  • phone number,
  • driver's license,
  • email address, and
  • home postal address,

but does not include your credit card number or billing information

In order to process some of your transactions through the Services, we may also ask for your credit card number and other billing information ("Billing Information") (Identity Information and Billing Information together: "Personal Information").

Some Personal Information is required, like your:

  • name and
  • email address.

Other Personal Information is optional, like your date of birth.

We use your Personal Information to provide the Service and administer your inquiries.

We collect Personal Information in connection with your registration to join the Service. You can register to join via the Site or Services by completing the required forms.

You can also register on FishingBooker by logging into online accounts you may have with third party service providers ("TPA") (e.g. Facebook); each such account is considered a "Third Party Account" on our Site or Application as described below. As part of the functionality of the Site, Service, and Application, you may link your FishingBooker Account with Third Party Accounts, by either:

  1. Providing your Third Party Account login information for FishingBooker through the Site, Service or Application; or
  2. Allowing FishingBooker to access your Third Party Account, as permitted under the applicable terms and conditions that govern your use of each Third Party Account.

You represent that you are entitled to disclose your Third Party Account login information to FishingBooker and/or grant FishingBooker access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating FishingBooker to pay any fees or making FishingBooker subject to any usage limitations imposed by the Applicable TPA. If you decide to register by logging into a Third Party Account via our Site or Application, we will obtain the Personal Information you have provided to the applicable TPA (such as your "real" name, email address, profile pictures, names of TPA friends, names of TPA groups to which you belong, other information you make publicly available via the applicable TPA, and/or other information you authorize FishingBooker to access by authorizing the TPA to provide such information) from your Third Party Account and use that information to create your FishingBooker Account and FishingBooker Account profile page, and you will become a Vendor or a Customer. Depending on the Third Party Account you choose and subject to the privacy settings that you have set in such Third Party Account, you understand that by granting us access to the Third Party Account, we will access, make available, and store (if applicable and as permitted by the TPA and authorized by you) the information in your Third Party Account so that it is available on and through your FishingBooker Account on the Site, Service, and Application. If there is information about your "friends" or people with whom you are associated in your Third Party Account, the information we obtain about those "friends" or people with whom you are associated, may also depend on the privacy settings such people have with the applicable TPA.

We also collect other information that you provide as part of registration, administration, and personalization of your FishingBooker Account profile (e.g. without limitation, zip code (on its own) and individual preferences, or demographic information ("Non-Identifying Information")).

We use your Personal Information (in some cases in conjunction with your Non-identifying Information) mainly to provide the Service, complete your transactions, and administer your inquiries.

Certain Non-Identifying Information is considered a part of your Personal Information if it is combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your demographic information). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other FishingBooker Users (defined below) to attempt to provide you with a better experience, to improve the quality and value of the Service, and to analyze and understand how our Services are used. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your preferences or restrictions.

We also use your Personal Information to contact you with FishingBooker newsletters, marketing or promotional materials, and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications or update your "Notifications" information (see "Changing or Deleting Information" below). We may also share the combined information without aggregating it to partners we feel may have material benefit to you or your use of the Site. Please note that we may also use your Personal Information to contact you with information related to your use of the Service or services from Partners; you may not opt out of these notifications.

Google Data Usage:

If you choose to link your Google Account with FishingBooker for account creation, we will obtain the following information: your email address, name, profile picture, and language preferences.

FishingBooker's use and transfer to any other app of information received from Google APIs adheres to Google API Services User Data Policy, including the Limited Use requirements.

Google Calendar:

If you choose to link your Google Calendar account with FishingBooker, we will obtain the following information, access, and permissions:

  • Access to your calendar events
  • Permission to add or remove calendar events in relation to the bookings created via the FishingBooker platform
  • Read-only access to the ID of your primary calendar. This information is obtained solely for the purpose of the functionality of the calendar synchronization.

Data retention and sharing

We store your data while your account is active, for service provision, and as required by law, to resolve disputes, enforce agreements, and protect FishingBooker.

We may share some data with third parties to improve our services.

International Transfer

Your information may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, FishingBooker transfers personal information to the United States and Serbia and processes it there. Your consent to this privacy policy followed by your submission of such information represents your agreement to that transfer.

Compliance with Laws and Law Enforcement

FishingBooker cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, at our sole discretion, believe necessary or appropriate to respond to claims and legal processes (including but not limited to subpoenas), to protect the property and rights of FishingBooker or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, any illegal, unethical, or legally actionable activity.

Changing or Deleting Your Information

All Vendors and Users may review, update or correct their Personal Information by editing the relevant part of their profile or by contacting us via customer.service@fishingbooker.com. If you would like us to cancel your FishingBooker Account, please contact us via customer.service@fishingbooker.com and we will attempt to accommodate your request if we do not have any legal obligation or a legitimate business reason to retain the information contained in your FishingBooker Account. Please note that, if you cancel your FishingBooker Account, any reviews you have posted via the Services will remain publicly viewable via the Services.

If you wish to change or delete your information and you are based in the EU or California, please let us know at dpo@fishingbooker.com. For more information please refer to the GDPR Privacy Notice and the CCPA Privacy Notice.

Confidentiality

Except for any personally identifiable information we may collect from you under the guidelines established in our Privacy Policy, any content posted to the Site will be considered non-confidential and non-proprietary. You are responsible for maintaining the confidentiality of your Account and password, whether or not you thereof authorize use. To enhance the value of your experience on the Site, FishingBooker, Inc. and its affiliates may on occasion share selected personal information at all times during and after providing such information.

Location Data

When you use the FishingBooker for Captains mobile app and/or FishingBooker for Customers mobile app, FishingBooker, may collect and process information about your actual location. We use GPS coordinates to determine your location while using the app or while it is turned on in the background. We use this information to better tailor our services to you and others. This information will not be shared with third parties unless in compliance with a lawful government request or legal process, or unless you request for us to do so.

Phishing

Identify theft and the practice currently known as "phishing" are of great concern to FishingBooker. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your FishingBooker Account ID, login password, or national identification numbers in a non secure or unsolicited email or telephone communication. For more information about phishing, visit the Federal Trade Commission's website at http://www.ftc.gov.

Aggregate Information and Non-Identifying Information

We may share aggregated information that does not include Personal Information and we may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling, and other purposes. Any aggregated information shared in these contexts will not contain your Personal Information.

Web Beacons and Do Not Track Requests

Our Services may contain electronic images known as Web beacons (sometimes called single-pixel gifs), which are used along with cookies to compile aggregated statistics to analyze how our Services are used and may also be used in some of our emails to let us know which emails and links have been opened by recipients. This allows us to gauge the effectiveness of our customer communications and marketing campaigns.

We do not honor Do Not Track Requests.

Service Providers

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Site and Application-related services (e.g. without limitation, maintenance services, database management, web analytics, fraud detection services relating to the activity of FishingBooker Users, and improvement of the features of the Service), or to assist us in analyzing how our Services are used. These third parties may have access to your Personal Information; if they do, this access is only so that they may perform these tasks on our behalf and they are obligated not to disclose or use it for any other purpose. We may also provide Personal Information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you. You can opt out of receiving such communications at any time.

Log Data

When you visit the Services, whether as a registered User or a non-registered User just browsing (for any of these, you are considered a "FishingBooker User"), our servers automatically record information that your browser sends whenever you visit a website ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, or the webpage you visited before you came to our Services, pages, or features of our Services that you visit or use, the time spent on those pages, information you search for on our Services, access times and dates, and other statistics. We use this information to monitor and analyze use of the Services and for the technical administration of the Services, to increase the functionality and user-friendliness of the Services, and to better tailor our Services to our visitors' needs. We also use this information to verify that visitors to the Services meet the criteria required to process their requests. We do not treat Log Data as Personal Information or unless used in association with other Personal Information, though we may aggregate, analyze, and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.

Our Policy Towards Children

The Site and Application are not directed to individuals under 18. We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, they should contact us. If you become aware that a child under 13 has provided us with Personal Information, please notify us via customer.service@fishingbooker.com so that we can delete such information from our files.

Cookie Policy

FishingBooker uses cookies, mobile identifiers, tracking URLs, log data, and similar technologies to help provide, protect, and improve the FishingBooker Platform Software, Website, and Services, further referred to as the "Products". This Cookie Policy (“Policy”) supplements and complements the FishingBooker General Privacy Policy and GDPR Privacy Notice and explains in more detail how and why we use these technologies and the choices you have.

Why FishingBooker Uses These Technologies

We use these technologies for a number of purposes, such as:

  • to enable you to use and access the FishingBooker Platform Products and its Payment Services;
  • to enable, facilitate, and streamline the functioning of and your access to the FishingBooker Platform Products;
  • to better understand how you navigate through and interact with the FishingBooker Platform Products, and to improve the FishingBooker Platform Products;
  • to serve you tailored advertising (such as on the FishingBooker Platform Products, through emails and texts, and on third-party websites);
  • to show you content (e.g., advertisements) that is more relevant to you;
  • to monitor and analyze the performance, operation, and effectiveness of the FishingBooker Platform Products and FishingBooker advertisements;
  • to enforce legal agreements that govern the use of the FishingBooker Platform Products;
  • for fraud detection and prevention, trust and safety, and investigations;
  • for purposes of our own customer support, analytics, research, product development, and regulatory compliance.

Cookies

When you visit the FishingBooker Platform Products, we may place cookies on your device. Cookies are small text files that websites send to your computer or other Internet-connected devices to identify your browser uniquely or to store information or settings in your browser. Cookies allow us to recognize you when you return. They also help us provide a customized experience and can enable us to detect certain kinds of fraud. In many cases, the information we collect using cookies and other tools is only used in a non-identifiable manner without reference to personal information. For example, we may use the information we collect to better understand website traffic patterns and optimize our website experience. Sometimes, we associate the information we collect using cookies and other technology with your personal information. Our business partners may also use these tracking technologies on the FishingBooker Platform Products or engage others to track your behavior on our behalf.

Functional Cookies:

Functional Cookies enable our website to work properly, so you can create your account, sign in, and manage your bookings. They also remember your selected currency, language, past searches, and other preferences. These technical cookies must be enabled to use our site and services.

Analytics Cookies:

Analytics Cookies help us understand how customers use FishingBooker. This means we can improve our website, apps, and communications, and ensure we continue to be interesting and relevant.

Marketing Cookies:

FishingBooker and our trusted partners use third-party Cookies. These Cookies are used to display personalized advertisements both on FishingBooker and other websites. These adverts are based on your browsing, such as charter listings you have viewed. These cookies also integrate social media on our site, allowing you to like or share pages or products on social media.

Your Preferences

You can set or amend your web browser controls to accept or refuse Cookies whenever you like, but please remember if you do choose to reject Cookies, your access to some of the functionality and areas of our site may be restricted.

Information we gather when you communicate with us and/or other FishingBooker Users and how we use it

Information Sharing and Disclosure

Overview: The Services can be used to facilitate the listing and booking of fishing trips. Listings for such fishing trips are made available via the Services by Vendors. Listings posted by Vendors, ratings and reviews of Vendors and Customers (those who reserve fishing trips), and the Profile Information ( as defined below) of Vendors and Customers, are visible to any FishingBooker User.

Should a FishingBooker User require information about (an)other User(s), the User should make an official request in appropriate form to FishingBooker representatives in order for the request to be processed. Based on the nature of the request and information disclosed, FishingBooker may or may not honor the request.

Analyzing Your Communications

We may review, scan, analyze, and store all communication (including emails, phone calls, messages, etc.) sent or received using FishingBooker communication tools, (including communications with other Users) for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, and customer support purposes. For example, as part of our fraud prevention efforts, we scan and analyze messages to mask contact information and remove references to other websites. In some cases, we may also scan, review, or analyze messages to debug, improve, and expand product offerings. Automated methods are used whenever reasonably possible, however, we may need to manually review some communications occasionally. This may be done to provide customer support or conduct fraud investigations, as well as to assess and improve the functionality of these automated tools. We will not review, scan, analyze, or store your communications to send third-party marketing messages to you and we will not sell reviews or analyses of these communications.

We reserve the right to block the delivery of or review communications that we, at our sole discretion, believe may contain malicious content, spam, or that may pose a risk to you, our Users, FishingBooker, or others.

These communications and their contents may be disclosed: in response to lawful government requests or legal process, in other circumstances in which we have good faith that a crime has been committed by the use of our services or that an emergency that poses a threat to the safety of our users or another person exists, if it is necessary to protect our rights or property, or in order for us to render the service you have requested.

User-Vendor Communications

You agree that, with respect to other Vendors' or Users' personal information that you obtain directly or indirectly from or through the Website or through any Website-related communication, transaction, or software, we have granted to you a license to use such information only for:

  1. Website-related communications that are not unsolicited commercial messages,
  2. Using services offered through the Website, and
  3. Inquiring about or otherwise facilitating a financial transaction between you and the other Vendor or User related to the purpose of the Website (such as inquiring about or booking an online fishing trip and transacting payment).

Any other purpose will require express permission from the other User and written permission from a FishingBooker Inc. representative. You may not use any such information for any unlawful purpose or with any unlawful intent. If it is discovered that a Vendor is using customer information obtained through FishingBooker to then book the customer directly and avoid paying FishingBooker a commission, this will result in the termination of the Vendor's account.

Recording Phone Calls

Please note that calls to and from FishingBooker may be recorded. We may use the call recordings to monitor our customer service for quality and compliance purposes, to check the accuracy of the information, and to provide training to our staff. We will keep the call recordings for as long as is reasonably necessary to perform such activities and then delete them. Any personal information accessed during these calls will be treated in accordance with this Privacy Policy and its provisions.

FishingBooker Vendors and Customers

Vendors

When you create a FishingBooker Account, we will set up a FishingBooker Account profile page for you. Your FishingBooker Account profile page will include:

  • your first name and last name, and
  • connections you have established between your Account and any TPAs,
  • and a biography and links to your Listings.

You can select other items of Personal Information that you wish to be included in your FishingBooker Account profile page including but not limited to a profile picture or other information known as your "Profile information". We will display your Profile information on your FishingBooker Account profile page publicly via the Services and on third party sites at our sole discretion. If you are a resident of California and wish to limit the sharing of your information, please let us know at dpo@fishingbooker.com, for more information please refer to our California Privacy Notice. Any information you choose to provide as part of your Profile Information will be publicly visible to all FishingBooker Users and, consequently, should reflect how much you want other FishingBooker Users to know about you. We recommend that you guard your anonymity and sensitive information, and we encourage Vendors to think carefully about what information about themselves they disclose in their profile pages. You can review and revise your Profile information at any time.

Customers

When you create a FishingBooker Account, we will set up a FishingBooker Account profile page for you. You can select other items of Personal Information that you wish to be included in your FishingBooker Account profile page, including but not limited to a profile picture or other information known as your “Profile Information”. Any information you choose to provide as part of your Profile information will be visible to Vendors with whom you choose to interact and on any public reviews you post, and, consequently, should reflect how much you want other FishingBooker Users to know about you. We recommend that you guard your anonymity and sensitive information, and we encourage Customers to think carefully about what information about themselves they disclose in their profile pages. You can review and revise your Profile information at any time.

Listing

If you post a Listing, we may publish that Listing publicly via the Services and may enable third parties to publish your Listing on their website through the use of a HTML "widget". We may also display the geographical location of your Listing in the form of a map to potential Users.

If you request to make a booking via the Services, FishingBooker will share the following information about you with the applicable Vendor:

  1. Your first and last name
  2. A link to your FishingBooker Account profile page where the Vendor can view your booking history, reviews, and description.

All of this information will enable the Vendor to decide whether to confirm or reject your booking. When a Vendor confirms a booking, we will share pieces of the Vendor's Identify Information including but not limited to full name, phone number, the Vendor's address, and the Vendor's email address with the applicable User selected by the Vendor, and we will share pieces of the User's Identity Information with the Vendor including but not limited to full name, phone number, and email address, so that the User and Vendor may contact one another directly. In no event is a User's Billing Information shared with a Vendor.

Links to Other Websites

Our Services may contain links to other websites. If you choose to visit an advertiser by "clicking on" a banner ad or other type of advertisement or click on another third-party link, you will be directed to that third party's website. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization, or representation unless specifically stated. Please note that we have no control over the content and practices of these third-party websites. Therefore, we cannot be held responsible for the protection and privacy of any information you provide while visiting such sites. We encourage you to exercise caution and review the privacy policies of these external websites before providing any personal information.

Security

FishingBooker is very concerned with safeguarding Users' information. When Users enter sensitive information (such as social security numbers) on FishingBooker registration or order forms, we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. If Users have any questions about the security of our Services, they can contact us via customer.service@fishingbooker.com.

FishingBooker will make any legally required disclosures of any breach of the security, confidentiality, or integrity of our unencrypted electronically stored "personal data" (as defined in applicable state statutes on security breach notification) to Users via email or conspicuous posting on the Services in the most expedient time possible and without unreasonable delay, insofar as consistent with:

  1. The legitimate needs of law enforcement; or
  2. Any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

Access to Your Account

FishingBooker will have the right to access your account to make any changes to reservations, listings, or profile information at its sole discretion.

California Privacy Notice - Notice at Collection

This supplement to the FishingBooker Privacy Policy sets out the rights and disclosures that Users are entitled to under the CCPA/CPARA, and applies to any California residents that may use the FishingBooker platform.

Definitions

By "FishingBooker/us/we/our", we mean the features and services we make available, through our Platform - including the website fishingbooker.com (https://fishingbooker.com), the FishingBooker for Captains and the FishingBooker for Customers mobile applications and any other branded or co-branded websites (including sub-domains, international versions, widgets, mobile applications, and mobile versions) already existing or later developed.

By "User(s)/you", we mean any person, agency, or company advertising or using any of the services provided on the FishingBooker platform. The term "User" refers to both our Customers and Vendors.

By "Service(s)", we mean the reservation of fishing trips through the FishingBooker platform, through which Vendors can make their fishing trip services available online for reservation, and through which Customers can make such fishing trip reservations with Vendors.

By "Consumer" we mean, for the purposes of the CCPA (California Consumer Privacy Act), a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.

By "Cookies" we mean small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

By "Device" we mean any device that can access the Service such as a computer, a cell phone or a digital tablet.

By "Personal Information", we mean any information that relates to an identified or identifiable individual. Under the CCPA (California Consumer Privacy Act), Personal information is any that identifies, delates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly with You.

By "Sale" we mean selling, renting, releasing, disclosing, disseminating, making available, transferring or otherwise communicating orally, in writing or by electronic or other means, a Consumer's personal information to another business or a third party for monetary or other valuable consideration.

By "Service Provider" we mean any natural or legal person who processes the information on behalf of the FishingBooker. It refers to third-party companies or individuals employed by FishingBooker to facilitate our service, to provide services on behalf of FishingBooker, to perform services related to our service or to assist FishingBooker in analyzing how our service is used.

General info about CCPA/CPRA and what this part of the policy is about

The California Consumer Privacy Act of 2018 (CCPA) and the California Privacy Rights Act of 2020 (CPRA) provide residents of California certain rights regarding their personal information and how to exercise those rights. The CCPA and CPRA are laws enacted in California, which brought changes to how Californian's personal information was protected by businesses who had access to it.

What information we collect and why

We collect information that identifies, relates to, describes, references, can be associated with or could be reasonably licked to a particular User or device. Below is a list of categories of personal information which has been collected and which we may collect in the future from California residents.

  • Identifiers - A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, driver's license number, passport number, or other similar identifiers
  • Personal information categories listed in the California Customer Records statute - A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, bank account number, or any other financial information.
  • Protected classification characteristics under California or federal law - Age (40 years or older), race, color, citizenship, medical condition, sex, veteran or military status).
  • Commercial information - Records and history of products or services purchased or considered.
  • Biometric information - Not collected.
  • Internet or other similar network activity - Interaction with our Service or advertisement
  • Geolocation information - Approximate physical location
  • Sensory information - Not collected.
  • Professional or employment-related information - Not collected.
  • Non-public education information - Not collected.
  • Inferences drawn from other personal information - Not collected.

Sources of personal information

  • Some of the personal information we get directly from you, when you input your personal information into the FishingBooker platform.
  • Some personal information we get indirectly, by observing your activity on the FishingBooker platform.
  • Some we get automatically from you, through cookies that we place on your device.
  • Some personal information we get from service providers, such as third-party vendors who monitor and analyze the use of our platform, third-party vendors for payment processing or other third party vendors that we use to maintain the platform for you.
  • Where applicable, we get information from public sources.

Disclosure of Personal Information for Business Purposes or Commercial Purposes

We may use or disclose and may have used or disclosed in the last twelve months the following categories of personal information for business or commercial purposes:

  • Category A: Identifiers

We do not knowingly collect personal information from minors under the age of 16 through the FishingBooker platform.

If you have any reason to believe that a child under the age of 16 has provided Us with personal information, please contact us with sufficient detail to enable us to delete that information.

We do not sell our User’s information.
