All Content and copy edits submitted by Vendors are subject to review and approval at FishingBooker's sole discretion. We reserve the right to refuse to publish any Content that we determine, at our sole discretion, does not comply with the Terms or is otherwise unacceptable to us. However, we assume no duty to review Content and we will not accept any liability for any loss or damage resulting from the design or positioning of the copy, properties, Content, and/or photographs, or any change made to any Content, photograph, or copy submitted by any Vendor. All Content must meet these Terms. We reserve the right to edit Content submitted to comply with these Terms, Platform Rules and Guidelines, and established content quality standards or formatting requirements.
By posting any content on the FishingBooker platform, you consent that some parts of your account, such as the Captain's biography, listing and trip description, boat description, pick-up location, and other information may be edited by FishingBooker in order to enhance the presentation and quality of the content to Customers, to edit the information to reflect the reality based on the credentials prior provided by the Vendor, or for any other reason related to the quality and accuracy of the displayed content.
Vendors are responsible for reviewing and ensuring that any Content displayed on the Website appears as the Vendor intended.
FishingBooker does not accept any references to the Vendor's personal website or contact details, and reserves the right to remove any such references. In case of infringement of this policy, FishingBooker reserves the right to block a Vendor's use of the site.
Posting any Content that FishingBooker deems threatening, defamatory, infringing, unlawful, abusive, obscene, vulgar, indecent, inflammatory, sexually explicit, pornographic, profane, libelous, harassing, or otherwise objectionable is prohibited. You also agree to not post Content that violates any third-party rights, including any Intellectual Property Rights, rights of publicity, and privacy. FishingBooker reserves the right to remove Content at its sole discretion.
For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, FishingBooker, Inc. and its successors, licensees, and assigns are granted all rights to a Vendor’s Content, including rights for commercial use of a Vendor’s name, image, likeness, or any other identifiable aspect of identity. By listing and posting Content, Vendors grant FishingBooker, Inc. an irrevocable, sub-licensable, transferrable, perpetual, non-exclusive, royalty-free, worldwide license to use, duplicate, modify, publish, alter, translate, distribute, publicly perform, publicly display, make derivative works of, and list information regarding all Content and technology now known or developed in the future for FishingBooker’s and its successors' and affiliates’ business.
Each User of the Service is hereby granted a non-exclusive license to access a Vendor’s Content through the Service and to use, reproduce, distribute, display, and perform such Content as permitted through the use of FishingBooker’s Service. By listing and posting Content, a Vendor waives any rights to royalties or other compensation arising from or related to the use of the Vendor’s Content. There is no time limit on the validity of the release nor is there any geographic limitation on where the Vendor’s Content may be distributed. By agreeing to the FishingBooker Terms of Use, a Vendor acknowledges that they have completely read and fully understand the release and agree to be bound thereby and that agreement will be binding upon their heirs, legal representatives and assignees.
By receiving verified customer reviews or providing FishingBooker-produced testimonials, Users assign, transfer, and convey to FishingBooker all intellectual property rights, title, and interest. FishingBooker may use, duplicate, modify, publish, alter, translate, distribute, publicly perform or display, and make derivative works of all reviews, testimonials, and technology now known or developed in the future for FishingBooker’s and its successors' and affiliates’ business. For any further use of reviews and testimonials outside of the FishingBooker platform, Vendors, Customers, or any other third party needs to receive direct consent from FishingBooker.
If you choose to use FishingBooker's photography/video service, you agree that FishingBooker will own all rights, titles, and interests in and to the copyright rights in the resulting images.
FishingBooker’s mission is to bring Captains and Anglers from all around the world closer together. FishingBooker has undertaken a project to create videos for Vendors who list on our platform. Due to the number of Vendors that are listed and continue to list, it is a process that will take time and effort. Vendors are filmed in an order defined by objective terms that include but are not limited to the number of successful bookings, customer reviews, accessibility of Vendor’s location, time spent on the FishingBooker platform, etc. FishingBooker does not give any material or non-material goods to Vendors for creating videos, nor does it receive them from Vendors in exchange. By creating videos, FishingBooker does not endorse any Vendor, Customer, or listing.
Videos created by FishingBooker are offered to the public for information and entertainment purposes only. FishingBooker uses its best efforts in producing these videos but does not make any representation or warranties with respect to the accuracy, applicability, fitness, or completeness of the contents of videos. Vendors are required by this Agreement to provide accurate information. However, FishingBooker does not guarantee results nor make warranties as to their success or safety. Any risk remains solely with the User and how they interpret the video information.
The information contained in these videos is strictly for entertainment and informational purposes. Therefore, if you wish to apply concepts or ideas contained in these videos, you take full responsibility for your actions. FishingBooker will not, in any event, be held liable to any party for any direct, indirect, implied, punitive, special, incidental, or other consequential damages arising directly or indirectly from any use of this material, which is provided as is, without warranties.
The information presented in videos on the platform reflects details that were accurate at the time of recording. Certain aspects of a trip, including pricing, duration, availability, included services, or other conditions, may change over time and may not be reflected in the video content. FishingBooker does not guarantee the ongoing accuracy or completeness of the information shown in such videos and is not responsible for any changes that may occur after the recording. For the most current and accurate information, users should refer to the relevant trip listing and details available on the FishingBooker platform.
As in all cases, viewers should not rely solely on information presented in videos or other content on the platform and should conduct their own due diligence when evaluating any material. Where appropriate, the advice of a qualified legal, tax, accounting, or other professional should be sought before taking any action.

FishingBooker respects the intellectual property rights of others and expects its Users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, FishingBooker has implemented procedures for receiving written notification of claimed infringements and for processing such claims in accordance with the law. It is the Vendor's obligation to ensure the accuracy of all listing Content (accuracy of boat description, seaworthiness of boat, qualifications of captain(s), legal requirements, identification requirements for renters, insurance, etc). If a Vendor discovers that their listing details are inaccurate or incorrect, it is the Vendor's sole responsibility to correct the information in the Vendor account interface or contact a FishingBooker representative to resolve any such error.
FishingBooker may, without notice to Users, suspend or cancel a User's account at any time without receiving notice from them or giving notice to them if we suspect, at our sole discretion, that their account with FishingBooker or their email account is being used in an unauthorized or fraudulent manner. By adding FishingBooker Widgets ("Widget(s)") to your website, you agree to be bound by the FishingBooker Terms of Use.
FishingBooker grants you a personal, non-exclusive license to download, install, and run Widgets on your website in a manner consistent with applicable law and with the FishingBooker Terms of Use (including, without limitation, all disclaimers and limitations of liability set forth therein).
